Terms of Service

These terms ("Terms") apply when you use nospicebooks.com (the "Site"), operated by No Spice Books ("we", "us"). By using the Site you agree to these Terms. If you don't agree, please don't use the Site.

Informational use only

The Site is provided for general informational and entertainment purposes. Book descriptions, ratings, summaries, and recommendations are subjective opinions and may be wrong or incomplete. Reader experiences vary. Always use your own judgment about what to read.

Eligibility

To use the Site you must be at least 13 years old and able to enter into a binding contract. If you're using the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Your account

You're responsible for keeping your account credentials secure and for activity that happens under your account. We can suspend or remove accounts that violate these Terms. You can stop using the Site at any time and delete your account by contacting us.

Acceptable use

You agree not to:

• Use the Site or its content for any unlawful purpose.
• Interfere with the Site, attempt to break its security, or overload it.
• Submit content that infringes on someone else's rights or that is harmful, abusive, or misleading.
• Misrepresent who you are.

Scraping and commercial reuse

The content on the Site — including book listings, ratings, summaries, author information, lists, reviews, descriptions, and any other compilation of data — is ours (or licensed to us) and is provided for your personal, non-commercial use.

Without our prior written permission, you may not:

• Scrape, crawl, copy, harvest, or otherwise extract content from the Site by automated means or in bulk.
• Use any of our content to train, fine-tune, or evaluate a machine learning or AI model intended for commercial use.
• Republish, resell, or redistribute our content, in whole or in part.
• Use our content to build, populate, or operate a competing or commercial product or service.

Liquidated damages. Because the actual harm from unauthorized scraping or commercial reuse is hard to measure, you agree that if you violate this section you owe us liquidated damages of $100 per record accessed, copied, or reused, with a minimum of $10,000 per incident, plus our reasonable costs of enforcement (including attorneys' fees). This is in addition to any other remedies available to us, including injunctive relief.

Normal use by search engines and AI assistants for the purpose of helping people find or learn about us is welcome and not restricted by this section.

Content you submit

When you submit ratings, reviews, lists, book information, or other content, you grant us a worldwide, royalty-free, perpetual license to host, display, and use that content in connection with operating and promoting the Site. You're responsible for what you submit and confirm you have the right to submit it. We may remove any content at our discretion.

No warranties

The Site and everything on it is provided "as is" and "as available", without warranties of any kind, express or implied. We don't guarantee that the Site will be available, accurate, complete, current, secure, or error-free, and we don't warrant that any content will meet your expectations.

Limitation of liability

To the fullest extent permitted by law, No Spice Books and anyone associated with it will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or use, arising from or related to your use of the Site — even if we've been advised of the possibility. Our total liability to you for any claim related to the Site is limited to $100 in the aggregate.

Indemnification

You agree to defend, indemnify, and hold us harmless from any claim or demand, including reasonable attorneys' fees, arising out of your use of the Site, your violation of these Terms, or your violation of any rights of another.

Copyright complaints (DMCA)

We respect the intellectual property rights of others. If you believe content on the Site infringes your copyright, send us a notice that includes:

• A description of the copyrighted work you claim has been infringed.
• The URL or other location of the allegedly infringing material on the Site.
• Your name, address, phone number, and email address.
• A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
• A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
• Your physical or electronic signature.

Send notices through our contact form. We may remove or disable access to material we believe in good faith to be infringing, and we may terminate accounts of repeat infringers.

Third-party links

The Site links to third-party sites (book retailers, social media, and others). We're not responsible for those sites or anything you do on them.

Governing law and venue

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or your use of the Site must be brought exclusively in the state or federal courts located in Hamilton County, Indiana, and you consent to the personal jurisdiction of those courts.

Severability and waiver

If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full effect. Our failure to enforce any right or provision isn't a waiver of that right or provision.

Entire agreement

These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Site and supersede any prior agreements on the same subject.

Changes

We may update these Terms from time to time. The "last updated" date at the top will reflect the most recent change. Continuing to use the Site after a change means you accept the updated Terms.
